Sigh...
Sometimes I feel like I'm wasting my life studying law.
I have always looked upon Lady Justice with love and respect, more than towards any other woman in my life (well... except Mama, Big Sis Nur, Princess Fatin, my late Opah, Tun Dr. Siti Asmah...).
But the madness that is happening in the Malaysian Bar Council is slowly causing me to lose faith in justice. I feel so... betrayed.
The Bar Council is now corrupted by people who do not understand the nation's history that has built and framed the law as it is today. The current members are all drama but no facts. How on earth could Zaid Ibrahim propose for a panel of these drama kings and queens to appoint members of the judiciary?
I now cringe at the thought of being called to the Bar in the future. I'd rather die than become a lawyer whose practising certificate is issued by these jokers.
What's wrong with having a DNA Act? Does every Act have to be rejected because it is deemed as a "government conspiracy"?
How sad and angry I am to see the Bar Council representative going against Pak Mid's explanation on the procedure of DNA sampling in the news. I have been at the Forensics Department with him in Cheras, and I have seen with my own eyes how DNA profiling is done. Not only that, our elite class has also been personally trained by Pak Mid to do DNA sampling. The accuracy of a DNA test is 99.9% and that is a fact beyond reasonable doubt.
These people at the Bar Council demand evidence for everything. But when it comes to cold hard evidence, they deny its admissibility. Hypocrites.
Another thing is that they don't even have any idea what preventive law is about. Why the hell do they keep mixing up preventive law with criminal law? Even a high schooler can see that both laws don't have the same function.
The aim of preventive law is to PREVENT possible threat from occurring, not to punish a wrongdoer for a crime that has been done. Logically thinking, such law cannot be applied with the dictum “one is innocent until proven guilty”. Preventive law is not a part of criminal law as it has its own jurisdiction governed by the Internal Security Act, even though criminal acts stated in the Penal Code are encompassed within preventive law.
Malaysia is not the only country to have such preventive law; even the United States of America has the Patriots Act which serves similar function as the ISA and it is greatly supported by the citizens after the World Trade Centre incident.
So they want the element of actus reus be proven in trial before detention. Fine.

If my mind serves me correctly, actus reus is not a necessity to prove every crime. Even in criminal law, having only the mens rea to commit a crime suffice for conviction, e.g. intention to commit murder under Section 307 of the Penal Code.
Imagine this - if a serial rapist is planning to rape a woman and has that woman in his clutches, should we look and wait until he has finished raping that woman so that we can prove him guilty for a crime?
That's it, I've made up my mind. I am going to provide my service in the judiciary department after I finish my studies. I am going to work hard to become a judge and redeem my Lady Justice's honour.
I swear I am going to fight for my love.
