LAWYERS IN HOT WATER

Once again, the father and son team hit the news with their controversial antics.

Gobind Suspended, Karpal to be Charged

DAP chairman Karpal Singh faces a sedition charge in the Kuala Lumpur Sessions Court. The veteran politician and lawyer was served with a notice yesterday to present himself at the courts in Jalan Duta hours after his second son and Puchong MP Gobind Singh Deo was suspended from Parliament for a year.

Gobind Singh’s suspension was effective from yesterday. The Dewan Rakyat had voted for a motion to have him suspended from Parliament for alleging that Deputy Prime Minister Datuk Seri Najib Tun Razak was involved in a murder case and for contempt against the Speaker.

Karpal Singh, who is Bukit Gelugor MP, had allegedly threatened to sue the Sultan of Perak Sultan Azlan Shah for acting beyond his powers and consenting to the appointment of a new Perak Mentri Besar.

Karpal Singh had threatened to take legal action against Sultan Azlan Shah following the appointment of Datuk Dr Zamry Kadir as Perak Mentri Besar, after deposing Datuk Seri Mohammad Nizar Jamaluddin

“We have not decided on the legal team yet,” said Sangeep Kaur.

It was also not sure if Karpal Singh would represent himself.

The fiery lawyer’s statement caused anger among many parties and groups.

Over 100 police reports have been lodged nationwide and hundreds took to the streets demanding that Karpal Singh issue a public apology to the Perak royal family.

This is not the first time he has faced charges under the Sedition Act.

In 2002, he was acquitted and discharged by the High Court of uttering seditious words at the sodomy trial of PKR de facto leader Datuk Seri Anwar Ibrahim two years after he was charged with the alleged offence.

GOBIND Singh Deo (DAP – Puchong) has been suspended for a year for alleging that Deputy Prime Minister Datuk Seri Najib Tun Razak was involved in a murder case and being in contempt of the House. The suspension came after the Dewan Rakyat voted for a motion against him.

Gobind Singh will also not be paid any allowance or given any benefits accrued to MPs during the suspension, which began yesterday.

Dewan Speaker Tan Sri Pandikar Amin Mulia called for a voice vote at 1pm in the midst of intense uproar and the Opposition staging a walk-out.

Minister in the Prime Minister’s Department Datuk Seri Mohamed Nazri Abdul Aziz tabled the motion under Standing Order 27 (3).

According to the motion, Gobind Singh, had on Thursday, accused Najib of the crime and insulted Deputy Speaker Datuk Ronald Kiandee after he was ordered to leave the House.

It added that the allegation against Najib was serious, breached the rights and privileges of an MP and was in contempt of the House.

On Thursday, Gobind Singh was ejected from the House for a third time when he persisted in speaking about Mongolian Altantuya Shaariibuu’s murder case despite the chair ordering him to stop.

Nazri later told reporters that Gobind Singh’s suspension was because he had abused his immunity as an MP.

He added that Gobind Singh’s statement was malafide or made in bad faith.

When asked by reporters why Gobind Singh was not referred to the parliament’s select privileges committee, Nazri said the Puchong MP’s actions were plain for all to see while the committee’s job was to investigate the facts.

“But the facts were right before us. It was verbatim and the witnesses were many,” Nazri said.

It just goes to show that lawyers must remember the number one rule of their profession - ALWAYS BE ETHICAL. Also, the next thing that a lawyer should not forget - NEVER ACCUSE WITHOUT PROOF. Presumptions are dangerous to the mind.

Seriously, calling someone a murderer when there is no evidence at all... where did Gobind Singh get his law degree from? The same goes for his dad, who accused the BN Youth members as the culprits who sent him a death-threat letter containing live bullets. What, did those bullets have the words BN engraved on it?

Evidence is everything. If you state something without evidence, then you're making no sense at all. Don't be surprised to find yourself in hot water when you come up with something senseless. The Malays have a saying that goes: "Kerana pulut, santan binasa; kerana mulut badan merana". It means a person should watch what he says in case he doesn't want to land into trouble.
